Medicaid Planning

The Medicaid program is a federal program administered by New York State in conjunction with local social service districts such as the Nassau and Suffolk County Departments of Social Services or the New York City Human Resources Administration (HRA). It is a complex system of rules and regulations with many nuances. The rules are ever-changing, and one should seek counsel from an experienced elder law attorney who regularly practices in the area. We have successfully handled hundreds of Medicaid applications for our clients.

There are different types of Medicaid coverage, namely community Medicaid and Nursing home Medicaid/Chronic Care Medicaid. Community Medicaid covers home care services, acute hospital care, prescriptions, and all other services, except nursing home care. Nursing Home Medicaid covers all of the same services of community Medicaid and covers nursing home daily rate charges. The current average monthly nursing home cost in New York is approximately $14,000.00.

Medicaid Applications

The Medicaid application on its face looks straightforward, but in practice, the process is quite complex due to the documentation and the myriad of ever-changing rules and regulations. Some liken the process to putting together a puzzle. The government is continuously adding pieces to the puzzle. For a person to be accepted into the Medicaid program, all puzzle pieces must fit together. Let us help you figure out the Medicaid puzzle. The law firm of Schneider Garrastegui & Fedele PLLC has successfully handled hundreds of Medicaid applications for their clients.

When Should You Plan?

There are two categories for Medicaid Planning. They are crisis planning and pre‐need planning.

Crisis Planning

This is for people facing an imminent need for long‐term care of some kind, whether it be Alzheimer’s, nursing home, hospice, or other care. Because of the intensive nature of legal work involved, this type of planning tends to be more expensive than pre‐need planning.

Pre-Need Medicaid Planning

The best way to plan for long‐term care is to do so well before the need arises. Beginning early enough allows you to take advantage of the five-year look‐back period, among other benefits.

Elder Law

Elder Law refers to the protection of an aging generation and disabled individuals that prioritizes ensuring their last desires are carried out. This can refer to guardianships, resuscitation in the hospital, drafting Wills and Trusts, division of property, Medicaid, and much more. Documenting desires and putting them legally in place before an illness or death helps to ensure property and assets are protected, and items such as funeral arrangements can be carried out to your wishes. It cannot reduce the amount of stress of your loved ones should an unfortunate event happen.

If you have a question regarding your rights or what you need to prepare for the later years of your life, contact us, we can help.

A guardian can affect those who, due to an accident or injury, are left unable to care for themselves or from an illness or advanced age that has progressed to the point the person will not be able to manage their own finances or property. A guardian can be a family member, lawyer, or organization. A guardian can be appointed to handle the personal care, finances and/or the property of the person who has become incapacitated. The process can be quite overwhelming and time-consuming. Numerous reports must be filed with the court based upon statutory deadlines.

As court examiners, we can obtain a unique view of the guardianship process from all sides. Our firm routinely handles various guardianship proceedings in all the Supreme Courts of Nassau County, Suffolk County, Queens County, Kings County, New York County, and Bronx County.
